Terms of Service

Welcome to TheraForge ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the TheraForge web application, APIs, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Accounts

The Service is intended for licensed mental health professionals operating in jurisdictions where they are authorized to practice. You represent that you are at least 18 years old and hold the licenses required for your clinical work. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

2. Clinical Responsibility

TheraForge provides AI-assisted drafting, scheduling, and administrative tools. You remain the sole clinician of record for every client and every note. AI-generated output is a draft and must be reviewed, edited where necessary, and approved by you before it becomes part of the clinical record. We do not provide medical, psychological, or legal advice.

3. Acceptable Use

  • Do not upload data you are not authorized to process.
  • Do not use the Service to harass, harm, or deceive any person.
  • Do not attempt to reverse engineer, probe, or disrupt the Service.
  • Do not use the Service for emergency or crisis response — TheraForge is not a 911 substitute.

4. Subscriptions & Billing

Paid plans renew automatically each billing period until cancelled. You may cancel at any time from your account settings; cancellations take effect at the end of the current period. Fees are non-refundable except where required by law.

5. Data & Confidentiality

Your clinical content belongs to you. We process it only to provide the Service, as further described in our Privacy Policy and (where applicable) our Business Associate Agreement. See our HIPAA page for our administrative, physical, and technical safeguards.

6. AI Processing

Audio transcripts and text you submit may be sent to third-party AI inference providers under contractual confidentiality obligations. We do not permit those providers to use your data to train foundation models. You can disable AI features at any time from Settings.

7. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms or that create legal risk for other users. Upon termination, you may export your data for 30 days, after which we will delete it unless we are required to retain it.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) US $100.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Delaware.

11. Changes

We may update these Terms from time to time. Material changes will be announced in-app at least 14 days before they take effect.
